I am an Accredited Specialist (Commercial Litigation – New South Wales and Victoria) and an experienced litigator with a strong background in all facets of commercial, insurance, construction, and personal injury litigation having conducted such litigation for plaintiffs and defendants.
I have been recognised for commercial advice that takes into account relevant issues including reserves, overall outcome including legal spend and media sensitive claims.
I am also frequently instructed to project manage litigation that requires the pooling of resources so as to streamline the advisory, reporting, pleading and evidence gathering processes. This inevitably leads to significant savings in legal costs and a reduction in ongoing exposure to clients resulting in multi-million dollar savings.
Who I work with and what I do
My recent experience includes:
- Instructing by various local government authorities in relation to construction and retail lease disputes, funding agreements, delegation of authority and tendering obligations
- Providing advice to various Councils in relation to litigation funding agreements and the relevant statutory provisions (including tendering obligations and delegation of authority) with respect to the desirability and ability of the Councils to enter into such arrangements
- Acting on numerous defective building work claims for developers and builders arising under contract and tort
- Defending public liability personal injury claims individually worth millions of dollars at the instruction of various insurers, predominantly for construction companies. Following satisfactory resolution to the insurer, I have acted to secure contribution from co-insurers
Where I studied
I have a Bachelor of Commerce (Accounting) and Bachelor of Laws (Honours) from Western Sydney University.
What I like to do
I am married with 2 beautiful boys and live in southern Sydney. My family originates in Ecuador, but I am proudly Australian. Cooking is my escape and how I relax – particularly South American BBQ (asado) and Spanish Paella (I am still perfecting both). I enjoy photography, design, architecture, and motor vehicles. As for sports, you will more likely find me watching soccer. A die-hard fan of no particular team, more a lover of the game.
